TERMS AND CONDITIONS OF USE FOR TMART (Turant Call Mart)

Effective Date: Baisakh 1, 2082

This Terms and Conditions Agreement ("Agreement") governs your access to and use of the multi-vendor e-commerce platform TMart ("Platform"), available at https://tmart.turantcall.com/ ("Website"), operated by Turant Call Pvt. Ltd. ("Company," "We," "Us," or "Our").

By accessing, registering, or using the Website, you ("User," "You," or "Your") acknowledge that you have read, understood, and agreed to be legally bound by this Agreement, along with our Privacy Policy, Return & Refund Policy, and Shipping Policy (collectively, "Policies"). If you do not agree with any provision of this Agreement, you must immediately cease using the Website.

1.  DEFINITIONS
   • "Buyer" refers to a registered user who purchases goods or services on the Platform.
   • "Seller" or "Vendor" refers to a registered user who lists and sells goods or services on the Platform.
     
   • "Product(s)" means any tangible or intangible item listed for sale on the Platform.
   • "Order" means a legally binding contract between a Buyer and Seller upon purchase confirmation.
   • "Content" includes text, images, videos, product descriptions, reviews, and any other material posted on the Platform.
2. ELIGIBILITY & USER REGISTRATION

   • Eligibility Criteria

     • Users must be at least 18 years of ageor the legal age of majority in their jurisdiction.
     • Businesses must provide valid registration and tax identification details (where applicable).
   • Account Registration
     • Users must provide accurate, current, and complete information during registration.
     • Each user is responsible for maintaining the confidentiality of login credentialsand all activities under their account.
     • TMart reserves the right to reject, suspend, or terminateaccounts suspected of fraudulent activity.
   • Seller Verification
     • Sellers must submit valid government-issued identification, business registration documents, and tax details(if applicable).
     • TMart may conduct background checks and reserves the right to reject seller applications at its sole discretion.
3. BUYER & SELLER OBLIGATIONS
   • Buyer Responsibilities
     • Must provide accurate shipping and payment details.
     • Agrees to pay the total order amount, including taxes and shipping fees.
     • Must comply with return and refund policieswhen applicable.
   • Seller Responsibilities
     • Must provide truthful, non-misleading product descriptions, images, and pricing.
     • Must fulfill orders within the stipulated timeframeand adhere to shipping policies.
     • Must resolve buyer disputes promptlyand process refunds when required.
     • Prohibited from listing counterfeit, illegal, or restricted items.
4. PRODUCT LISTINGS & TRANSACTIONS
   • Product Listings
     • Sellers must ensure listings comply with all applicable laws and regulations.
     •  
     • Prohibited items include, but are not limited to:

       • Counterfeit or pirated goods Weapons, drugs, and hazardous materials

       • Items infringing intellectual property rights

     • TMart may remove listings without notice if they violate policies.

   • Pricing & Payments
     • All prices must be clearly displayed, including taxes and additional fees.
     • Accepted payment methodsinclude credit/debit cards, digital wallets, and bank transfers.
     • TMart may charge transaction fees or commissions as per the seller agreement.
   • Order Fulfillment & Shipping
     • Sellers must dispatch products within the promised delivery timeframe.
     • Buyers must verify shipping details; TMart is not liablefor incorrect addresses.
     • Delivery delays due to third-party couriers are not the responsibility of TMart
   • Returns & Refunds
     • Governed by the TMart Return & Refund Policy
     • Buyers may request returns if the product is defective, damaged, or not as described
     • Sellers must process refunds within [X] business daysof approval.
5. PROHIBITED CONDUCT
   • Users must not:
     • Engage in fraud, scams, or deceptive sales practices.
     • Manipulate reviews or ratings.
     • Use the Platform for illegal activities.
     • Infringe on intellectual property rights.
     • Disrupt the Website’s functionality (e.g., hacking, spamming).
     Violations may result in account suspension, legal action, or financial penalties .

6. INTELLECTUAL PROPERTY RIGHTS

   TMart owns all rights to the Website’s branding, logos, and content (unless otherwise stated).

   Sellers must have legal rights to sell listed products.

   Unauthorized use of TMart’s trademarks is strictly prohibited.

   7. DISPUTE RESOLUTION

   TMart may mediate disputes between Buyers and Sellers.

   If unresolved, disputes may be escalated to binding arbitration or local courts in Kathmandu.

    

   8. LIMITATION OF LIABILITY

   TMart acts as an intermediary and is not liable for:

   Product quality or Seller misconduct.

   Shipping delays, lost packages, or customs issues.

   Technical errors or website downtime.

   Users engage in transactions at their own risk.

   9. PRIVACY & DATA PROTECTIO

   • Governed by the TMart Privacy Policy.
   • Personal datais collected for transactions, marketing (with consent), and legal compliance.

    

   10. MODIFICATIONS TO TERMS

   TMart may amend this Agreement at any time.

   Continued use after changes constitutes acceptance.

   11. GOVERNING LAW & JURISDICTION

   This Agreement is governed by the laws of Nepal, Company Laws.

   Disputes shall be resolved in Judicial Court Nepal.
